Welcome to Fardoss. These Terms of Service ("Terms") govern your access to and use of the Fardoss website, online store, products, services, and related features (collectively, the "Service").

The Service is operated by Fardoss LLC ("Fardoss", "We", "Us", or "Our").

By accessing the Service, placing an order, or purchasing a product from Fardoss, You agree to these Terms. If You do not agree with these Terms, You should not use the Service or place an order.

Eligibility

By using the Service or placing an order, You represent that You are legally capable of entering into a binding agreement or are using the Service with the authorization of a parent or legal guardian.

You are responsible for ensuring that the information You provide to Fardoss is accurate, complete, and current.

Our Products

Fardoss sells phone cases and related products, including cases featuring pre-designed artwork and, where available, products customized using content provided by customers.

We make reasonable efforts to display product colors, designs, dimensions, finishes, and other characteristics accurately. However, the appearance of a product may vary slightly from images displayed on the Service due to screen settings, manufacturing variations, printing processes, device models, materials, and other factors.

Product availability is not guaranteed. We reserve the right to modify, discontinue, limit, or replace products at any time.

Orders

Submitting an order constitutes an offer to purchase the products included in the order.

We reserve the right to accept, reject, or cancel an order for reasons including, but not limited to:

• Product unavailability.

• Incorrect pricing or product information.

• Suspected fraud or unauthorized transactions.

• Payment authorization problems.

• Shipping or fulfillment limitations.

• Violations of these Terms.

• Errors affecting the Service or order.

Receiving an order confirmation does not necessarily mean that an order has been finally accepted or shipped.

If We cancel an order after payment has been collected, We will issue an appropriate refund for the canceled portion of the order.

Pricing and Payment

Prices are displayed in U.S. dollars unless otherwise stated. Prices, promotions, discounts, shipping charges, and product availability may change without notice.

You agree to pay all charges associated with Your order, including applicable product prices, shipping charges, and taxes.

Payments made through the Service are processed by Stripe, a third-party payment processor. When You submit payment information during checkout, Your payment information is provided directly to Stripe for payment processing.

Fardoss does not directly receive or store Your complete credit or debit card number. Stripe may collect and process payment information, billing information, and other information necessary to complete and secure Your transaction in accordance with Stripe's own terms and privacy practices.

By submitting payment information, You represent that You are authorized to use the payment method provided and authorize Stripe and Fardoss to process the applicable charges associated with Your order.

Payment authorization does not guarantee acceptance of an order. We reserve the right to reject or cancel an order in accordance with these Terms, including in cases of suspected fraud, payment failure, pricing errors, or product unavailability.

If a payment is declined, rejected, or otherwise cannot be processed, Your order may not be completed or fulfilled. Fardoss is not responsible for fees that Your bank, card issuer, or other financial institution may charge in connection with Your transaction.

We reserve the right to correct pricing, typographical, promotional, or other errors, including after an order has been submitted. If an error materially affects Your order, We may contact You, cancel the affected order, or provide a refund.

Checkout Information

To process and fulfill an order, We may require You to provide certain personal information, including:

• Email address

• Telephone number

• Billing address

• Shipping address

• Other information reasonably necessary to process, deliver, support, or verify Your order

We may use this information to process orders, arrange shipment and delivery, provide order updates, prevent fraud, provide customer support, handle returns or refunds, and comply with applicable legal obligations.

Shipping and Delivery

Fardoss uses Shippo and third-party shipping carriers to facilitate shipment and delivery of orders. Shipping labels, rates, tracking information, and other shipping services may be generated or managed through Shippo.

Shipping estimates provided by Fardoss, Shippo, or a shipping carrier are estimates and are not guaranteed delivery dates unless expressly stated otherwise.

Delivery times may be affected by circumstances outside Our reasonable control, including carrier delays, weather, holidays, incorrect addresses, customs procedures, transportation disruptions, and other events.

You are responsible for providing a complete and accurate shipping address and other information necessary to deliver Your order. Fardoss is not responsible for delays or failed deliveries resulting from inaccurate or incomplete information provided by You.

If an order is returned to Us because of an incorrect, incomplete, or undeliverable address, additional shipping charges may apply before the order can be shipped again.

Returns, Refunds, and Cancellations

Fardoss accepts eligible returns within 30 days of the date Your order is delivered. Return requests submitted more than 30 days after delivery will not be accepted, except where otherwise required by applicable law.

To be eligible for a return, the product must be unused, in its original condition, and returned with its original packaging. We reserve the right to refuse a return if the product shows signs of use, damage, modification, or other conditions that make it ineligible for return.

To request a return, You must contact Us at [email protected] within 30 days of delivery and provide Your order information and the reason for the return. Do not send a product back to Us without first requesting a return.

Customized, personalized, made-to-order, or otherwise specially produced products are not eligible for return or exchange unless the product arrives defective, damaged, or materially different from what was ordered, or where otherwise required by applicable law.

If You receive an incorrect, defective, or damaged product, please contact Us as soon as reasonably possible with Your order information and photographs or other information reasonably necessary for Us to investigate the issue.

Approved refunds will be issued to the original payment method used for the purchase. The time required for a refund to appear may depend on Stripe, Your bank, card issuer, or other financial institution.

Original shipping charges and return shipping costs are non-refundable unless the return results from an error by Fardoss, a defective or damaged product, or otherwise required by applicable law.

Orders that have already entered production, been customized, or been shipped may not be canceled. If You need to request a cancellation, please contact Us as soon as possible. We cannot guarantee that a cancellation request can be completed before production or shipment begins.

Nothing in these Terms limits any consumer rights or remedies that cannot be waived or restricted under applicable law.

Custom Phone Cases and User-Provided Content

Fardoss may allow customers to upload photographs, artwork, text, graphics, logos, or other content ("User Content") for use in customized products.

You retain ownership of any rights You hold in Your User Content.

By submitting User Content for customization, You grant Fardoss a limited, non-exclusive license to reproduce, modify, crop, resize, format, print, manufacture, and otherwise use the User Content as reasonably necessary to create, fulfill, reproduce, replace, ship, or provide support for Your order.

By submitting User Content, You represent and warrant that:

• You own the User Content or have sufficient permission to use it.

• Fardoss's use of the User Content to fulfill Your order will not infringe another person's copyright, trademark, privacy, publicity, or other rights.

• The User Content does not violate applicable law.

• You are authorized to request that the User Content be reproduced on the product You order.

Fardoss may refuse or cancel customization requests that We reasonably believe violate these Terms, applicable law, intellectual-property rights, or Our content policies.

Intellectual Property

Except for User Content and third-party materials, the Service and its contents, including Fardoss branding, logos, graphics, product designs, photographs, website content, software, text, and other materials, are owned by or licensed to Fardoss and are protected by applicable intellectual-property laws.

Purchasing a Fardoss product does not transfer ownership of the underlying artwork, design, trademark, copyright, or other intellectual-property rights associated with that product.

You may not reproduce, distribute, sell, commercially exploit, copy, modify, or create derivative works from Fardoss-owned content except with Our prior written authorization or as otherwise permitted by law.

Prohibited Uses

You may not use the Service:

• For unlawful or fraudulent purposes.

• To infringe intellectual-property or other rights.

• To submit false or misleading information.

• To attempt unauthorized access to the Service or related systems.

• To interfere with the security or operation of the Service.

• To distribute malicious software or code.

• To impersonate another person or entity.

• To use the Service in any manner prohibited by applicable law.

Promotions and Discount Codes

Promotions, coupons, discount codes, free-shipping offers, and other special offers may be subject to additional conditions.

Unless otherwise stated, promotional offers have no cash value, may not be combined with other promotions, and may be modified or discontinued at any time before an eligible order is completed.

We reserve the right to reject or cancel the improper or fraudulent use of promotional offers.

Third-Party Services

The Service relies on third-party service providers to operate certain features of Our business. These providers include Stripe for payment processing and Shippo for shipping, shipment management, and the generation of shipping labels. We may also use shipping carriers, hosting providers, analytics providers, and other vendors necessary to operate the Service and fulfill Your order.

In order to fulfill and ship Your order, We may provide Shippo and applicable shipping carriers with information necessary to process Your shipment, such as Your name, shipping address, telephone number, email address, order information, package information, and other information reasonably necessary for shipment and delivery.

Your use of certain third-party services may be subject to the terms, conditions, and privacy policies of those third parties. Fardoss does not control independent third-party services and is not responsible for their separate services, terms, privacy practices, availability, or conduct except to the extent required by applicable law.

Privacy

When You use the Service or complete a purchase, We may collect information necessary to operate the store and fulfill Your order, including Your name, email address, telephone number, shipping and billing addresses, order information, device information, and other information described in Our Privacy Policy.

We may share information with service providers when reasonably necessary to operate Our business, such as payment processors, shipping carriers, hosting providers, customer-support providers, fraud-prevention services, and analytics providers.

Our collection, use, retention, and disclosure of personal information are governed by Our Privacy Policy.

Electronic Communications

By placing an order or providing Your contact information, You consent to receive transactional communications relating to Your purchase, including order confirmations, receipts, shipping notifications, delivery information, customer-service communications, security notices, and other communications necessary to complete or support Your transaction.

Transactional communications are separate from marketing communications. Where required by applicable law, promotional email or SMS communications will be sent only with the appropriate consent, and applicable communications will provide a method to opt out.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Service and products are provided on an "as is" and "as available" basis except for warranties that cannot legally be excluded.

We do not warrant that the Service will always be uninterrupted, error-free, secure, or available.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law.

Limitation of Liability

To the fullest extent permitted by applicable law, Fardoss LLC and its owners, employees, affiliates, agents, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to Your use of the Service or purchase of products.

To the fullest extent permitted by applicable law, Fardoss's aggregate liability arising from a particular purchase will not exceed the amount You paid to Fardoss for the product or order giving rise to the claim.

These limitations do not apply where liability cannot legally be limited or excluded.

Indemnification

To the extent permitted by applicable law, You agree to indemnify and hold harmless Fardoss LLC and its affiliates, officers, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from Your User Content, Your unlawful use of the Service, Your infringement of another person's rights, or Your material violation of these Terms.

Force Majeure

Fardoss will not be responsible for delays or failures caused by circumstances beyond Our reasonable control, including natural disasters, severe weather, fires, labor disruptions, transportation interruptions, carrier failures, power or telecommunications outages, governmental actions, supply-chain disruptions, epidemics, pandemics, or similar events.

Governing Law

These Terms are governed by applicable laws of the United States and the applicable state laws governing Fardoss LLC, without regard to conflict-of-law principles, except where consumer-protection laws require otherwise.

You may have additional rights under the laws of the state or country in which You reside.

Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect to the extent permitted by law.

No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

Changes to These Terms

We may update these Terms from time to time to reflect changes to Our business, products, Service, policies, or applicable laws.

When We make changes, We may update the "Last Updated" date displayed at the beginning of these Terms.

Changes become effective when posted unless otherwise stated or required by applicable law. Your continued use of the Service after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.
